Joaquín Moeckel, lawyer for the Pagés company, organizer of the bullfighting festivities in the Maestranza in Seville, went through the microphones of El Toreo, of the Cadena Ser de Sevilla. The Andalusian lawyer analyzed the situation of tense waiting regarding the decision of whether or not there will be bulls in the capital of Seville as of next April 18 and the current norm that establishes the distance of one and a half meters between people who have so strictly interpreted the Junta de Andalucía.
“Article 14 of Law 2/2021 says that there must be 1.5 meters of distance between people but that article also says” when it is not possible to maintain said safety distance. ” And when is it not possible? It will always be possible. I ask the jurists of the Junta de Andalucía: when the legislator says “it is not possible”, what is he referring to? That distance will always be possible “, he says. “What the Pagés company does is: listen, since I can’t put people at five feet because the show has to be viable, not profitable, it proposes a series of complementary measures”.
The measures to which Moeckel refers are reflected in the Contingency Plan presented by the company Pagés last Wednesday, which includes the performance of antigen test tests to the attendees, the distribution of FPP2 masks, the taking of temperature, opening doors in advance … “They will not distribute hand programs to avoid contact, the public will not be allowed to get up to go out, the distance between rows will be maintained. They are voluntary measures in addition to all the regulations established by law. In addition, I tell politicians that there is a law that declares bullfighting Intangible Heritage and that forces them to disclose and promote it. I want that law to be complied with and also to be done without any detriment to health security. It’s possible? If possible”.
Asked if the Junta de Andalucía would respond negatively to the plan presented, the Pagés company would put an appeal, Joaquín Moeckel responds: “We would have to talk to the businessman. I do not have the capacity to decide on possible appeals that were interposed. If it were up to me, I would appeal the decision because it would not comply with the law. It would also be an ideological resource because the lawsuits are very long and delayed in time and the start date of the festivities is April 18. I am not telling anyone from the Junta de Andalucía to let me give bulls, that speech of life or freedom, no. There may be bulls and health security for the spectators. Bulls can be given outdoors and have important security measures to avoid contagion. Selling the bull or pandemic speech is easy”.
