Retirees established outside France: the Government specifies the rules relating to the pooling of the management of proof of existence
On April 4, the Government published a decree relating to the mutualisation of the control of the proof of the existence of the beneficiaries of a retirement pension residing abroad.
The purpose of this decree is to specify the provisions introduced by the social security financing law for 2021.
The body responsible for the shared management of proof of the existence of retirees is appointed from among the members of Union Retraite [1]. He alone is competent to ask a pensioner to provide proof of existence at most once a year.
When a retiree does not justify his existence, the suspension of the payment of his pension can only take place after the expiration of a period of one month from the date indicated for the receipt of the proof of existence. .
Continuation or suspension
Any decision to maintain or suspend payment of a pension taken by a member of Union Retraite is binding on the other bodies which pay a pension to the retiree affected by the decision.
With regard to the fight against fraud and the control of the risks relating to the operations of control of the proof of the existence, the orientations are defined by the Union Retraite, which designates among its members the body in charge of these questions.
Notify of death
Finally, members of Union Retraite having knowledge by any means of the death of a pensioner must immediately inform the other compulsory retirement organizations.
The next step will be the supervision of the use of biometrics, which is also provided for by the social security financing law for 2021. The means that can be used and the guarantees provided for the protection of personal data will soon be specified by a decree in Council of State, taken after the opinion of the National Commission for Informatics and Freedoms (CNIL). Union Retraite is currently working on setting up a facial recognition device, modeled on the Alicem application. [2].
