Fine proceedings on hold: radar measuring devices of the district of Coesfeld recalled – Münsterland

The driver from Münster was amazed when he was flashed in Havixbeck on October 13, 2020, despite the automatic sign recognition of his BMW and the adjusted speed. His feelings did not deceive the man from Münster, who would rather not read his name in the newspaper. The district of Coesfeld has to put numerous warning and fine proceedings on hold for speeding violations.

Deviations up to 16 km / h

The district administration had used Leivtec XV3 laser measuring devices, which have since been recalled by the manufacturer due to incorrect measurements with deviations of up to 16 km / h. According to Leivtec, several hundred devices are currently in use nationwide. The company has recommended that the authorities stop using its radar gauges.

In front of the exit sign in Havixbeck in the direction of Hohenholte there was a lightning that Tuesday. “That seemed strange to me. I hadn’t done anything, ”said the man from Münster about his expensive photo, which allegedly confirmed that he was 23 km / h too much and earned one point in Flensburg. “It’s annoying, but I thought that taking action wouldn’t help anyway,” says the long-time driver. So he paid. Now he found out about the recall on television and took a closer look at his notice of the fine. In fact, the said measuring device was noted there.

Hundreds of people affected

When asked, the district of Coesfeld confirms that devices of this brand have been used – incidentally, differently than in the rest of the Münsterland. The number of fines, which may now be invalid, cannot be determined quantitatively at the moment, says Hartmut Levermann from the Coesfeld district press office. In view of the almost daily measurements, it can be assumed that several hundred road users have been affected in the past few months alone. “The district administration is now using available instruments from the manufacturer Jenoptik,” said Levermann. The speed measurements are therefore continued.

Incidentally, the police are not affected by the recall. “We only work with devices from ESO,” says Britta Venker, press spokeswoman for the Coesfeld district police authority.

Advice from the lawyer

The Coesfeld lawyer Torsten Peckedrath has good advice for everyone concerned: “If the objection period of two weeks has not yet expired, you should always file an objection – regardless of whether or not you have already paid.” deleted again, explains the lawyer. If the objection period has already expired, only those cases would have a chance of success in which the fine exceeds 250 euros.

But that doesn’t help the Munster any more. He paid 108.50 euros to the Coesfeld district. “The point does not matter to me, but it annoys me the most.”
