Jakarta – Marzuki Alie et al withdrew the lawsuit related to the request to revoke the decision letter (SK) of his dismissal by the Head of the Democratic Party (PD) Agus Harimurti Yudhoyono (AHY). What is the reason?
“Maybe he (Marzuki Alie et al) has seriously considered why it was revoked, so we have it today ordered by him that withdraw the lawsuit. (The reason) one of them is the reason that they will focus on the outcome of the KLB, that’s all, the rest did not provide further explanations, “said lawyer Marzuki Alie et al, Slamet Hasan, after the trial at the Central Jakarta District Court, Tuesday (23/3 / 2021).
Slamet said the six plaintiffs, namely Marzuki Alie, Tri Yulianto, Damrizal, Achmad Yahya, Yus Sudarso, and Syofwatillah Mohzaib, have long intended to withdraw the lawsuit. However, the decision to withdraw the lawsuit was only agreed today.
“The one who signed the revocation was us as the authority, but represented the six plaintiffs. All six of them revoked, not just Mr. Marzuki ajaMaybe one of them is that they are already focused on KLB, it means that he is in their version of the Democrats. So they think that the AHY’s version of democrats is irrelevant, “said Slamet.
Meanwhile, the lawyer for the AHY camp, Mehbob, assessed that the withdrawal of the lawsuit was carried out because Marzuki Alie et al not sure of the lawsuit. According to him, the party’s internal problems must be resolved in the party court.
“When it comes to this revocation, the withdrawal of the plaintiffs may be that the plaintiff is not sure of his lawsuit, with legal standing-because it is clear according to the Revised Political Party Law of 2008 Number 2/2011, that the precise determination of cadres or political parties must be resolved in the party court, while the plaintiffs immediately file a lawsuit at the district court, I think maybe the defendants are not sure about legal standing-so they withdrew, “said Mehbob after the trial.
Mehbob admitted that currently his party is waiting for the continuation of Marzuki Alie et al’s stance, whether to file a lawsuit at the PD court or not. Until now, said Mehbob, the PD court has not received a lawsuit from anyone regarding the SK dismissal.
Mehbob also responded to the statement of lawyer Marzuki Alie et al, Slamet Hasan, who said Marzuki had considered the AHY faction PD as irrelevant. Mehbob emphasized that currently the management of PD under the Ketum PD AHY is still valid in the eyes of the law.
“If they think of it like that, the fact that until now is that the PD chaired by AHY is legal, which has been passed by the state, namely the Decree of the Menkumham, until now there has been no cancellation or revocation,” said Mehbob.
It is known, at the inaugural trial of the lawyers team Marzuki Alie et al as plaintiffs AHY et al withdrew their lawsuit. The revocation is submitted before the lawsuit is read out in court.
