Halle administrative court stops city council meeting on Wiegand suspension – you are Halle

The city council cannot meet on Monday to temporarily suspend Mayor Bernd Wiegand.

The Halle Administrative Court stopped the meeting of the City Council of the City of Halle on March 15, 2021. Actually, the city council, as the mayor’s superior, wanted to decide whether he should be temporarily prohibited from conducting his official business because of the vaccination affair.

Lawyer Johannes Menke, also a member of the city council, sought preliminary legal protection because the summons to convene the city council had not been met. The administrative court gave the applicant the right and prohibited the city council meeting for March 15, 2021 because the 14-day notice period for summoning city council members, which is applicable according to the city council’s rules of procedure, had not been observed. This was done one day too late. There were no indications of an emergency meeting of the city council. The applicant could not be instructed to assert the lack of summons during or after the meeting because the violation of his rights as a city council member with the improper summons to the city council meeting has already occurred.
