A 35-year-old was sentenced to a total of eleven years imprisonment by the Augsburg Regional Court on February 21, 2021 (source: www.augsburger-allgemeine.de/augsburg/Vergewaltigung-und-Drogenhandel-Eventmanager-muss-elf-Jahre-in-Haft). The convicted person, an event manager from the techno scene, raped a young woman and traded banned drugs by the kilo, according to the Augsburg Regional Court.
When do drugs result in long prison sentences?
This always depends on the individual case. Lawyer and specialist lawyer for criminal law Christian Steffgen has received suspended sentences for offenders who – without prior entries – were caught with narcotics in the kilogram range. This is often no longer possible with prior entries.
Anyone who acts as a member of a gang that has joined forces to continue committing such acts is punished with imprisonment for no less than five years in accordance with Section 30 a BtMG if he cultivates, produces, and trades narcotics in not small quantities without permission imports or exports (Section 29, Paragraph 1, Clause 1, No. 1).
A custodial sentence of not less than two years is punished for anyone who illegally cultivates, manufactures or trades narcotics (Section 29 (1) sentence 1 no.1) and acts as a member of a gang that has joined forces for the continued commission of such offenses, in the case of Section 29a, Paragraph 1, No. 1, acts on a commercial basis, dispenses narcotic drugs, administers them to another person or leaves them for immediate consumption and thereby carelessly causes his death or imports narcotic drugs in no small amount without permission.
In individual cases, however, imprisonment can be avoided even with larger quantities if the person concerned consults a defense lawyer who is experienced in narcotics law at an early stage.
