In Thionville, the judicial tribunal lacks arms and minds with a pacifying vocation to bring out those who one day found themselves in an impasse. A few figures to put the situation into perspective.
In 2020, 1,150 visits were counted in town halls and places where the auxiliary receives. 539 cases were processed, 368 reconciled, for 9 conciliators working in the territory. With this particularity that “the situations in which the plaintiffs are confronted and their sources of disputes are more complex than before”, underlines Bernard Lehalle, president of the conciliators of justice of Moselle.

Play a facilitator role
Pellets, the candidates for the function will deal with conflicts in terms of e-commerce, abusive sales, distance shopping, housing (between owner and tenant), noise pollution … To carry out its mission, “The conciliator should be aware that his role is to put the parties back into a situation of dialogue, that he will play a facilitator role, alongside legal professionals and experts, on whom he can count”, reassures Bernard Lehalle . And to insist on a fundamental thing: “We are not there, conciliator, to apply the law but (to make) it known. “
Important point: the function of conciliator is voluntary, and induces in the one who raises the finger to have free time. Four conditions are required: to be of legal age and to enjoy civic and political rights; justify an experience in legal matters – which the magistrate in charge of conciliation will assess -; not have an elective mandate in the jurisdiction of the court of appeal where the person wishes to exercise; and finally not to exercise judicial activity, nor to participate in the functioning of the justice service.
Last detail: a training cycle is provided by the National School of Magistrates, and tutoring is set up with an experienced conciliator. Regarding expenses, there are a few, just to cover operating costs.
