Handle. The intercommunal urban plan of Saint-Hilaire-du-Harcouët canceled at the request of the prefect

Justice canceled this Monday, February 22, 2021 the local urban plan of Saint-Hilaire-du-Harcouët (Manche).

At the request of the prefecture of Manche, the administrative court of Caen has just canceled the local intercommunal urban plan (PLUi) of the former community of municipalities of Saint-Hilaire-du-Harcouët, adopted in November 2019.

An “insufficient” report

The judges followed the opinion of the public rapporteur who had called for the cancellation of this urban plan, approved by the community of agglomeration Mont Saint-Michel – Normandy, born from the merger of five communities of municipalities, including that of Saint-Hilaire-du-Harcouët.

Like the magistrate, they pointed out the “insufficient and inconsistent character” of the presentation report of this PLUi.

In this document, it was described a territory, of approximately 13,000 inhabitants, facing a loss of population old one migration deficit and one low natural balance.

To meet these challenges of demographic attractiveness, it was notably a question of producing 960 homes by 2030, or an annual production of around 80 homes.

At the heart of the equation, vacant housing

The problem is the number of vacant dwellings already identified in the territory. This phenomenon tended to increase over time, with for example 238 additional vacant dwellings between 2008 and 2013. So much so that the proportion of abandoned dwellings rose from 6.9% to 13.4% of 2006 to 2013, i.e. a higher ratio than the 2013 departmental data (8.1%).

However, one of the stated objectives is precisely to fight against vacant housing and to obtain, over the duration of the plan, a reduction in vacant housing.

“The number of 80 annual housing units is not justified and is not consistent with the objective of eliminating vacant housing”.

This quantified objective, in order to maintain the population, could rather be about half as high according to them.

The document was thus deemed incompatible with the objectives of the town planning code, in particular those linked to urban renewal, the revitalization of urban and rural centers and the fight against urban sprawl.

As a reminder, this PLUi was intended to apply to the nine municipalities of the territory concerned, including three new municipalities: Grandparigny, Buais-les-Monts, Lapenty, Moulines, Saint-Brice-de-Landelles, Savigny-le-Vieux, Le Mesnillard, Les Loges-Marchis and Saint-Hilaire-du-Harcouët.
