A court in Siero has eximido a married couple with two minor children who have availed themselves of the Second Chance Law to pay the debt of 78,917 euros contracted with seven banking and financial entities due to the impossibility of repaying personal loans and card expenses after going through several periods of unemployment.
The Court of First Instance and Instruction number 2 of Siero has exonerated the marriage after applying the Consolidated Text of the Bankruptcy Law to verify that it would take more than 25 years to return the money even in the event that part of their income could be seized because both members of the couple are employed.
The 44-year-old man works as a salesperson and his wife, who is the same age, is a hairdresser, and although both are on staff at their companies, they have suffered several periods of loss of income alternating with stages of unemployment.
The judge has granted them the Benefit of the Exoneration of Unsatisfied Liabilities (BEPI) after verifying that they are debtors in good faith, not having a record of convictions in a final judgment for crimes against property, against the socioeconomic order, of documentary falsification, against the Public Finance and Social Security or against the rights of workers in the ten years prior to the declaration of insolvency.
The lawyer Ángela Elisa Álvarez has indicated that her clients were very overwhelmed by the situation since at all times they tried to reach agreements with the banks and financial entities to return the money, but it was impossible for them to meet the daily expenses of the domestic economy.
The lawyer explained that the court order, which is firm, will allow them to keep the family home and they have assumed the commitment to continue paying the mortgage; reported EFE.
