The Supreme Court of Justice upheld the 26-year prison sentence against the former deputy director of the Administrative Department of Security (DAS), José Miguel Narváez, as the determiner of the crime against humanity of Jaime Garzón on August 13, 1999.
The claim that the Court decided to reject was presented by the attorney for the former deputy director of the DAS, with which, he sought to annul the sentence already imposed in 2019. That action was inadmissible “due to lack of requirements and not observing any violation of guarantees.”
The lawyer’s lawsuit alleges flaws in determining tests that led to his conviction; However, the Court warns that when refuting the aforementioned evidence, it is of the utmost importance to specifically explain and effectively contrast what is sought to deny, especially without generalities, as said claim was apparently prepared.
According to the investigations that led to his conviction, Narváez would have taken advantage of his close relationship with Carlos Castaño Gil to suggest that he attempt against Garzón’s life, for alleged relations with the ELN guerrilla, and enrichment for his intervention in the liberation of the hostages.
In fact, in a meeting on one of his farms, Narváez, who worked as a teacher at the Military School, reportedly expressed the danger that Garzón’s “humanitarian work” represented. Because the murder of journalist Jaime Garzón was declared a crime against humanity, his case never prescribes.
The defense of former director Narváez insisted that it is clear that the judicial authorities were unable to verify that he was the determining factor in Garzón’s death. Despite this, the Supreme Court did not agree with him.
The Superior Court of Bogotá declared It has been proven that Narváez induced the paramilitary Castaño to order the murder of Jaime Garzón, a fact that materialized at dawn on August 13, 1999.
