In March 2019, former Vice Minister of Justice Kim Hak-eui turned to Thailand when he tried to leave for Thailand, but was blocked by an emergency departure ban just before boarding a plane at the airport.

The’Emergency Departure Prohibition Request’ submitted to the airport immigration authorities at the time contains the case number of the Seoul Central District Prosecutors’ Office, which was terminated in 2013 under the name of the aunt prosecutor of the Supreme Prosecutor’s Office’s past photographic investigation team.

In the’Emergency Departure Prohibition Approval Request Form’ to be approved by the Ministry of Justice, this prosecutor’s handwritten signature is recorded instead of the seal of the district prosecutor along with another number called Internal Office No. 1 of the Seoul Eastern District Prosecutors’ Office.

The public interest reporter claimed that the fact-finding team was not able to request a ban on departure because it did not have the right to investigate, and that the case number was also illegal, saying that the case was not under investigation.

Immigration officials at the Ministry of Justice also emphasized that they had illegally checked Kim’s immigration records over a hundred times in violation of the Personal Information Protection Act.

The Supreme Prosecutors’ Office reassigned the case to the 3rd criminal division of the Suwon District Prosecutors’ Office.

The investigation was entrusted to the Suwon District Prosecutor’s Office, where the Ministry of Justice is located, and then reassigned to the main office.

Suwon District Prosecutor’s Office, Chief 3rd Criminal Prosecutor, is Lee Jung-seop, who was put into the’Kim Hak’s Special Investigation Group’ last year.

At that time, former Vice Minister Kim was charged as a suspect and handed over to trial, but now, after seeing former Vice Minister Kim as a victim, the Ministry of Justice staff and the fact-finding team prosecutor were investigated for illegality.

The Supreme Prosecutor’s Office explained that as Lee was in charge of the case of former Vice Minister Kim, the case was reassigned because it was believed that he would be able to fairly judge the allegations related to the ban on departure.

The Ministry of Justice believes that the ban on departure was virtually unlawful.

Since this prosecutor who requested a ban on departure corresponds to an investigative agency ordered by the Dongbu District Prosecutor’s Office, he claimed that he had the authority to grant an internal investigation and internal investigation number, and to request an emergency ban on departure.

In particular, he explained that there is a need to consider the urgent and inevitable circumstances that a former high-ranking official, who was under serious charges at the time, was on the verge of fleeing abroad at night.

Deputy Minister of Justice Lee Yong-gu, who was designated as leading the ban on departure from the country as the head of the legal office, also explained that he did not specifically engage in a recommendation to the past son-in-law about the need for prompt action.

It is noteworthy whether the chief prosecutor, who was put into Kim Hak’s investigation team last year and brought guilty to the second trial, will be able to screen out whether it is illegal this time against the Ministry of Justice.
