Judge Kim Joon-hyuk, the 5th criminal justice of the Seoul Central District Court, held the first trial date for former chief prosecutor Kim, who was charged with assault on the 12th. On the day of the trial, there is a duty to attend, so former chief prosecutor Kim also attended.
Former chief prosecutor Kim’s lawyer said, “We do not argue about the fact that we have contacted the victim,” but said, “However, a lot of matters irrelevant to the fact of the prosecution were written in the complaint.” He said, “We have the opinion that we need to change the complaint first,” he said. “After the change of the complaint is made, we will promptly disclose the evidence and opinions.” It is argued that there are many facts in the complaint that are not directly related to the assault, so that changes are necessary.
Accordingly, Judge Kim requested the prosecution to review the change of the complaint. The next date has been changed from the 26th to the 4th of next month at the request of former chief prosecutor Kim that it is necessary to review the application for witnesses according to the change of the complaint.
After the trial, former chief prosecutor Kim hurried out of the court without answering questions such as,’Do you admit the facts of violence or abusiveness,’ or’Do you have anything to say to former prosecutor Kim Hong-young?’
Former chief prosecutor Kim was handed over to trial on charges of assaulting Prosecutor Kim four times from March to May in 2016 when he was working at the Seoul Southern District Prosecutors’ Office. In May of the same year, prosecutor Kim was found dead at his home at the age of 33, leaving a note with the contents of “Salesmen who cannot sell things like this,” etc.
Prosecutor Kim’s violent remarks and assault against Prosecutor Kim were revealed as a result of a fact-finding investigation by the Prosecutors’ Office of the Supreme Prosecutors’ Office after Kim’s death. The Ministry of Justice dismissed former chief prosecutor Kim in August of the same year, but did not punish him.
Afterwards, when the Korean Bar Association accused former chief prosecutor Kim, who applied for registration as a lawyer in August 2019, on charges of coercion, assault, and insult, the prosecution applied only the charges of assault to indict.
