Lawyer Santiago Pedroza announced the presentation of a popular action of unconstitutionality before the Federal Justice of Salta against the voluntary abortion law that has not yet been promulgated.
The lawyer argued that the IVE is unconstitutional because it contradicts article 4 of the National Constitution which says “that life is protected from the moment of conception.” In addition, he said that the law is contrary to the provisions of Article 75, paragraph 22, which incorporates Argentina’s adherence to international treaties, and in particular named the Convention of Children’s Rights.
“In order to approve abortion, the Constitution must be modified,” he argued. The lawyer maintained that the action of unconstitutionality “can be brought by any citizen.” He considered that the presentation can be made even if the law is not promulgated, because he understands that it will be effective. However, until the closing time of this note, Pedroza did not confirm if he finally entered it.
The lawyer maintained that the protocol of Legal Termination of Pregnancy (ILE), which already allows abortion for reasons in the country “it was permissible because the woman claimed to have been the victim of a sexual crime, or (for health reasons) when the mother’s life was put at risk.” He stated that he does not agree with the ILE but that “beyond what you may think, it is legal reasoning.”
On January 1, in Salta, an unconstitutionality action against the ILE was also presented before the Federal Justice with the signing of the provincial deputies Cristina Fiore and Gladis Moisés and deputy Andrés Suriani. The federal judge Miguel Medina enabled the fair to deal with this resource.
As for Pedroza, the lawyer has also publicly supported his complaints regarding to the comprehensive protection law, to prevent, punish and eradicate violence against women.
