GPs, yes to home visits to Covid patients: the sentence of the State Council

Home visits by general practitioners to patients Covid in home quarantine are now allowed. The go-ahead comes from the Council of State, which accepted the appeal of the Lazio Region against the sentence of the TAR which it had considered existing, on the basis of art. 4 bis of Legislative Decree no. 18/2020, the prohibition for general practitioners to make this type of visit.

The sentence of the Council of State

Sentence no. 8943/2020 with which the Third Section of the Council of State, in acceptance of the appeal of the Lazio Region, reformed the sentence of the Lazio TAR, n. 11991/2020, which he had considered existing, on the basis of art. 4 bis of Legislative Decree no. 18/2020, the ban for general practitioners to make home visits to Covid patients in home quarantine. The Section clarified that “the meaning of the emergency provision in question” is not to exempt general practitioners, but is only “to relieve general practitioners, pediatricians of free choice and doctors of continuity of care, from ‘burden deriving from the pandemic explosion, supporting them with a structure capable of intervening at the patient’s home ». The Uscar, provided for by art. 4 bis of Legislative Decree no. 18/2020, are therefore intended to operate in synergy and in compliance with the skills and prerogatives of general practitioners and other indicated doctors, who, in science and conscience and in compliance with safety protocols, can continue to carry out home visits , even if the patient is suffering from Covid-19.
