The trial which will oppose Epic to Apple should have two witnesses who will be very well followed. The lawyers of the creator of Fortnite have indeed obtained justice that Tim Cook and Craig Federighi come to testify. A hearing dating back to December 15 proved Epic right on two points. The first is that Apple representatives will not be able to limit Tim Cook’s testimony to four hours. It is only after the manufacturer has provided the necessary documents requested by the complainant that the duration of the testimony of the boss of Apple can be determined.
The second victory of Epic during this hearing is that it will indeed be the vice-president in charge of software engineering who will come to testify, and not an intermediate manager, in this case Erik Neuenschwander. Epic convinced Judge Thomas Hixson that Federighi had greater freedom of decision than his subordinate, and that his testimony will therefore shed more light on Apple’s defense.
Apple did not leave empty-handed. The company has obtained from the court that Epic is limited in its requests for documents. The trial is to be held in May.
