When Xu Liming stepped out of the court, dozens of people outside the court applauded and cheered for her, and she embraced her friends and supporters one by one. Xu Liming said outside the court that she is currently in a complicated mood. She was tortured both physically and mentally due to numerous reports and court appearances in the past, as well as the prosecution’s sudden amendment of the charges. She thanked her family and friends for their support. She said that judging from the prosecution’s amendment of the charge, “they (police) is considered to be an indiscriminate arrest,” otherwise there is no need to change the charge. As for whether she would worry about the Attorney General’s appeal, she said, “Don’t worry about it. The Attorney General has the right to do it.”
Xu Liming (50) was originally charged with obstructing the police officer Zhuang Dalang who was properly performing his duties on the traffic lane of Queensway on September 29 last year.
Police Constable Zhuang’s Lang earlier confessed that she did not know Xu Liming was a social worker. He also said that Xu Liming was emotional when the case happened. Zhuang’s Lang warned her to leave without effect, and she crashed and fell twice. The defense questioned that the police officer fell into the water and emphasized that Xu Liming wore the shirt of “We are a social worker.”
The Magistrate Zhong Mingxin ruled that there was a key discrepancy between Constable Zhuang’s confession and the fragment. For example, he claimed that the position of the defendant when he first saw it did not match the fragment; he claimed to spread his hands to intercept the defendant, but the defendant ignored and continued to move forward. In the case, the clip is also not displayed. Zhong Guan therefore ruled that Zhuang’s confession was unreliable and did not give any weight.
Officer: Both falls of the police involved were accidents
As for Zhuang’s Lang fell twice, Zhong Guan believed that the first time he fell was because the defendant tripped and got out of balance, and then hit him again. The second time he fell was because a police officer patted the defendant’s raised hand. He only fell when he touched Zhuang Dilang, thinking that the two falls were accidents.
The magistrate continued that the crime took only 10 seconds, and “observed that the obstruction occurred at 10 seconds.” Furthermore, the defendant had been cooperating before the incident and followed the police officer’s instructions to leave, believing that she did not act to obstruct the police. She was found not guilty.
