Yarden does not have to pay for entire funeral policy holders

Funeral insurance company Yarden does not have to reimburse the full funeral expenses for holders of a package policy in kind. The court in Leeuwarden has ruled that Yarden had the right to amend the policies unilaterally.

Clients with a kind package were fully reimbursed until 1 January, up to and including the coffee and cake afterwards. Yarden decided to end that to get out of financial trouble. The insurance is therefore only good for a few thousand euros. Expenses that exceed this must be paid by the insured parties.

A group of customers did not accept this and went to court. The preliminary relief judge initially prohibited Yarden’s measure, but according to the court, the funeral insurance company is in its right.

According to the court, Yarden has no choice because otherwise the company would go bankrupt. The interest of the insured is not great enough, the court finds. The adjustment of the package in kind policy affects 390,000 policyholders.
