Erding handball performance center: damage grows insolvency AOK

The couple who lived in Klettham and who founded AMROC GmbH for the performance center had rented space for an office on Holzingerstrasse next to the clinic, had it converted at great expense and employed three administrative staff.

In May 2019, the then 66 and 53 year old “investors” had to answer for fraud before the Erding District Court. The investigations revealed a total loss of 90,000 euros, which had primarily been incurred by the craftsmen. The fact that the sum could be reduced to ten percent in the end is thanks to a lawyer who took over the business premises and largely paid off those who had been cheated.

The husband was sentenced to 18 months suspended prison sentence and 200 hours of community service, the wife to a fine of 1,350 euros on probation. The judgment is final.

It has now been announced that the damage is likely to increase by a further 10,000 to 12,000 euros. Because AMROC had not paid any social security contributions for health, long-term care or unemployment insurance for its staff, who never saw a cent of wages. AOK Bayern then applied for bankruptcy over the company. Now the Landshut insolvency court decided under the file number IN 217/20 that the application should be dismissed – for lack of assets. There is nothing to be gained from AMROC.

One possibility, albeit not very promising, remains with the cash registers: Since the GmbH was still in the process of being founded and is viewed more or less like a sole proprietorship, the AOK should now try to get the money from the couple themselves.
