Irritation
What often goes wrong when one of the children settles the inheritance is that he or she has no experience with this role. There is also often poor communication or sometimes nothing is done. This in turn leads to irritation and mistrust among the other heirs.
Because a death is emotional for those involved in any case, arguments can even lead to lawsuits in the worst case, according to the notaries and probate lawyers.
Thinking
Notaries therefore recommend that testators think carefully about their choice of executor. An executor who is a little further away from the family generally causes less arguments and problems. With a professional executor, that chance is even smaller.
In more than 60% of the cases, one of the children is appointed to settle the inheritance. No one was specifically named in a quarter of the cases.
Almost half of the people do not know what the role of executor entails. More than four in ten are also unaware that a fee may be charged for this. That the role may also be refused is known by more than half, according to the research.
