In this case, Kamal said the police applied Article 106 of the Criminal Code in conjunction with Article 110 of the Criminal Code in conjunction with Article 87 of the Criminal Code on Conspiracy to Commit Crimes against State Security.
Article 106 reads: A conspiracy committed with the intention of conquering the territory of the country in whole or in part under a foreign government or with the intention of separating part of the territory, is punishable by life imprisonment or temporary imprisonment for up to 20 years.
Then, Article 110 explains a number of alleged criminal offenses as referred to by conspiracy. For example, in paragraph (2) it is said that criminal offenses can be charged against people who prepare or facilitate crimes.
Some activities, for example, motivate people to commit crimes, have supplies of goods, and even try to prevent or hinder government action to prevent crime. If the charge is proven and a crime occurs, paragraph (5) of the article provides that the criminal sentence may be doubled.
According to Kamal, the elements of the alleged crime of treason in this case can be proven because there was a malicious consensus made by the suspects. They first met in the Padang Bulan area of Abepura at 17.00-21.00 WIT, Tuesday (30/11).
“They unfurled banners and sang songs and shouted ‘Papua Merdeka’ during the long march,” he said.

The Suspects Are Still Students
Separately, the Director of LBH Papua Emanuel Gobay said that eight people who were arrested and named as suspects were still students
They are named Melvin Yobe (29), Melvin Fernando Waine (25), Zoded Hilapok (27), Devion Tekege (23), Yosep Ernesto Matuan (19), Maximus Simon Petrus You (18), Lius Kitok Uropmabin (21). ), and Ambrose Francis Elopere (21).
“Eight students will be accompanied by the Papuan Law Enforcement and Human Rights Coalition, which has been accompanying them since December 1, 2021 until they are named suspects on December 2, 2021,” said Gobay.
Gobay said the legal team found several irregularities during the legal process carried out by the Papuan Police when referring to the Criminal Procedure Code (KUHAP).
However, Gobay has not been able to explain further the steps that will be taken by the legal team to address the discrepancy. His party will prove in court that the police accusations in this case are not true.
“The Papuan Law Enforcement and Human Rights Coalition in its division will prove whether the 8 Papuan students raising the Morning Star flag are guilty or the government has not fulfilled its obligations,” he said.
The raising of the Morning Star flag was carried out during the commemoration of the Free Papua Organization’s Anniversary, on December 1. The flag was installed in front of the Cenderawasih Gymnasium in Jayapura.
