The accident occurred on the country road in Lunde in Telemark on a Monday morning in June this year.
He took up hunting
The MC rider was out for a ride when a car overtook him.
According to the defendant, the car must have passed in front of him a very short distance, and then swerved right in front of him.
This meant he had to slow down sharply to avoid a collision, which the experienced motorcyclist found very scary.
So it went black for the 71-year-old, who decided to go after the car in front.
After a short time, the journey ended at the address where the car owner lives.
When the latter parked and got out of the car, he was greeted by an enraged motorcyclist.
Then the violence began.
With the helmet on, the attacker first strangled the 75-year-old by slamming his head against the roof of the car. Then he hit the driver with the flat of his hand.
The sequence of events was confirmed by images from a surveillance camera at the site.
According to the verdict, the photos show that four seconds elapsed from the moment the bike stopped until the rider went into physical attack.
I disagree on the sequence of events
The two are quite at odds about what really happened on the summer day in question.
The man who was attacked in his garage experienced overtaking very differently.
He told the court he had passed the motorcycle because the person in question had stopped very low speed and thought he had good distance up the road.
So it was word for word.
The biker’s defender, Monica Tveit Tjentland, believed that her client should be acquitted under the provocation rules, or be deemed to have acted in justified anger.
The prosecutor, Caroline Gunnesdal, considered that the incident could not however justify the subsequent violence in the garage.
The court understood that the incident could have a provocative effect on the motorcyclist, but not enough to justify any of the actions in the garage.
– The defendant is a well-grown man, who should have availed himself of other alternatives, says the sentence.
Sentenced to prison
The man was sentenced to 24 days in prison.
He also has to pay NOK 580 in compensation and NOK 5,000 in compensation to the offended 75-year-old. In addition, he has to cover the court costs of NOK 3,000.
The man’s defender, Monica Tveit Tjentland, says they will now look into the verdict thoroughly.
– My client is aware of the outcome, but we do not wish to comment further on the case until we have reviewed the judgment together. We may have to re-appeal, she tells NRK.
