5-year-old boy in California is accused of fatally stabbing his twin brother. This is reported by People.
Officers from the Santa Cruz County Sheriff’s Department responded to a report in the 200 block of Tucker Street in Scotts Valley, California.

Upon arrival at the place indicated in the report, the police learned that two brothers had quarreled. One of them grabbed a small kitchen knife and stabbed his twin during the fight.
Medical staff provided “life saving emergency” of the five-year-old boy. The child was taken to hospital, where, despite the efforts of doctors, he later died.

The investigation shows that “there is no indication of negligence or criminal activity on the part of any other party,” law enforcement officials were quoted as saying by People.
“In coordination with the District Attorney’s Office and in light of all the circumstances uncovered by our investigators, no charges will be filed against anyone involved. California law states that age, criminal intent and ‘knowledge of wrongdoing’ are the factors necessary for filing charges for a crime against a child,” law enforcement said.
Section 26 of the California Penal Code lists cases in which individuals “are incapable of committing crimes”. One of them is “children under the age of 14, in the absence of clear evidence that, at the time of committing the act for which they are accused, they were aware of its illegality”.
According to 602 of the California Welfare and Institutions Code, “any juvenile who is under the age of 12 years” when alleged to have committed a crime involving murder is “under the jurisdiction of the juvenile court.”
The Santa Cruz County Sheriff’s Department confirmed to People that no further information will be released at this time.
