JAKARTA, KOMPAS.com – PT Prospek Duta Sukses (PDS), project developer Antasari apartment 45 in the South Jakarta area, suspects that there are elements or parties manipulating process postponement of debt payment obligations (PKPU) which has the potential to sacrifice the consumer.
PDS Director Wahyu Hartanto conveyed this to Kompas.com through a written statement on Monday (21/9/2020).
“After going through the voting process creditors Last week at the Central Jakarta Commercial Court, information was obtained that support proposal peace PDS only proposes separatist creditors and around 60 consumers, “said Wahyu.

Meanwhile, most consumers have voted incorrectly due to incomplete and incorrect information and misleading input.
According to Wahyu, most of these consumers do not understand that not supporting PKPU means they are supporting the company’s bankruptcy process where consumer rights are no longer prioritized.
The official results of the new voting will be announced and ratified in the next few days.
He suspects that the wrong input comes from parties who have interests that are against the common goal of fulfilling the rights of consumers and creditors.
“It was also revealed that most of the consumers had given the power to have their votes represented by one or several parties,” he added.
Previously, PDS announced that the Company had received letters of interest from three potential investors.
Wahyu claims, the proposals submitted in front of creditors are concrete plans and actions that are credible and can be considered as a solution.

“We are really looking for investors who are not only strong in capital but also have experience and commitment,” said Wahyu.
If consumers do not support PKPU, said Wahyu, it will not produce the best decision.
In fact, there are more than 650 consumers who have the potential to lose money if the voting results actually decide to reject PKPU, which automatically means the company is bankrupt.
Responding to this, one of Oktavia Cokrodiharjo consumers who bought four units of Antasari 45 with a total value of IDR 8 billion, admitted that many consumers did not agree with the peace proposal made by PDS.
“This is because consumers have lost confidence in the PDS,” Cokro told Kompas.com, Monday (21/9/2020).
Cokro said, at the time of voting, consumers actually wanted an extension of time, with the hope that the PDS could improve its peace proposal.
Unfortunately, however, the PDS is adamant that the peace proposal is final and does not wish to improve it.
Then with regard to investor problems, according to Cokro, the initiative came from consumers, including beauty contest.
However, consumer demand was not granted, because the PDS wanted investors to step in after homologation.
This is what worries consumers because incoming investors are not necessarily competent and in accordance with their wishes to produce the best solution.
“Not yet thoroughly evaluating, consumers have been put up against voting. Yes, in the end we chose to reject the PDS peace proposal,” said Cokto.
The dispute between PDS and consumers originated from the slow progress of the construction of the Antasari 45 apartment.
Until now, the promised apartment can be handed over to consumers three years after the repayment period has not been built.
Instead of doing construction work, PT PDS was sued by PKPU by Eko Aji Saputra with case number 140 / Pdt.Sus-PKPU / 2020 / PN Niaga Jkt.Pst at the Commercial Court, Central Jakarta District Court (PN).
This PKPU lawsuit was questioned by consumers until it resulted in criminal reporting to the Jakarta Metro Police.
The reporting is carried out by the Legal Counsel Team Consumer namely, Bahari Abbas Pulungan with report number LP / 5187 / VIII / YAN.2.5 / 2020 / SPKT PMJ, dated 31 August 2020.
