The association 40 Million Motorists probably has none not finished with the low emission zone (ZFE) of Rouen. Interviewed by us a few days ago, his spokesperson, Pierre Chasseray, declared that a new attack on the legal level was under study. One more step, since this time it would be go to the criminal level :
“Two months ago (March 27, Editor’s note), we filed a legal appeal with the administrative court. It’s long. So we are going to release something much stronger in the coming days, with our criminal lawyer. This is the first clue. We’re going to go harder. It’s gonna go fast. »
The clearly stated objective for nearly a month is to lead to the nullity of this zone. It remains to be seen in detail what a new attack would involve. In April, representatives of 40 Million Motorists were already warning that they intended to launch new actions against the ZFE of Rouen.
On what points is the ZFE of Rouen attacked?
Remember that last March, 40 Million Motorists and the Automobile Distribution Federation (FEDA) filed a legal recourseat the Administrative Court of Rouen.
Both entities attack the setup of this area at three points. It concerns the attack on the freedom to come and go. But also the breach of equality with regard to exemptions and inconsistencies in the decree issued. 40 Million Motorists explains this on its website. :
The association disputes “on the one hand, the disproportionate attack on the freedom to come and go, a right protected by the Constitution. On the other hand, the breach of equality in the implementation of exemption measures. Finally, the order issued contains inconsistencies (however, the manifest error of assessment by an administration may justify the cancellation of its decision). »
Towards case law?
The objective is to obtain case law, in order to challenge the legality of all EPZs In France :
“While this first legal appeal is filed here against the Rouen ZFE, many of the arguments detailed in the appeal are valid against the Low Emission Zones of the 45 cities concerned by the ZFE-m law. The aim is therefore to obtain case law. »
let’s remember that 45 ZFEs will be set up in France by 2025. The latter will prohibit vehicles deemed too old from circulating within a certain perimeter.
