Four years required against the two defendants
On the merits of the case, the two defendants, placed in the same cell during their pre-trial detention, preferred to minimize their speaking time. Even pointing the finger at the smooth running of the investigation, which, according to the defence, could have revealed the alibi of one of the young people who could not be present at the scene, he who went to fetch his daughter from the nursery, at the time of the events, at the end of the afternoon.
For the public prosecutor, it is however indeed “an exchange of shots in the middle of the street”, motivated by an alleged dispute between the two acquaintances, two men residing in Nilvange and Fameck, both unfavorably known to the courts. Brice Partouche requested four years in prison against them.
The two lawyers pleaded for release, video surveillance and ballistic elements, which, they plead, did not lead to any real and serious proof against their clients. After two and a half hours of deliberation, the northern Moselle jurisdiction has decided. Nilvangeois Nassim Aissaoui is sentenced to three years in prison, with continued detention, along with a three-year ban on staying in the city of Fameck and a five-year ban on carrying a weapon. The release for the benefit of the doubt was pronounced for the Fameckois.
