3 defendants in rape-murder of middle school girl in Chinese cemetery face different charges

The Public Prosecutor (JPU) has issued various charges against three defendants in the case of the murder and rape of a young high school student AA (13) at the Talang Kerikil Chinese Cemetery, Sukami, Palembang.

The three defendants MZ (13), NS (12) and AS (12) were found guilty and charged separately. The defendant MZ was charged at a higher level than the defendants NS and AS at the trial held at Palembang Class 1 Court, Tuesday (8/10/2024).

“The illegitimate child (ABH) with the initials MZ was sentenced to 10 years. Meanwhile, NS and AS were sentenced to 5 years in prison each,” said the lawyer of the defendant Hermawan, Tuesday (8/10/2024). ).

Hermawan said that the three defendants were charged with several articles, namely 76 D juto 81 paragraph 5 of the Junto Defense Law 55 paragraph 1 of the Criminal Code. According to him, the three defendants should not be charged with various crimes as they have been proven innocent.

“From these requests, we will file a defense at the next trial,” he said.

Hermawan explained from the facts of the trial that the deceased died from the charge at 14.00-14.45 WIB. At the same time, what was confirmed by witness N was confirmed by a female witness who said that the victim was still alive at 14.00 WIB.

“So how could it be that he was already dead at 14.00 WIB. This is based on the BAP and the witnesses presented by the prosecution at the trial. We will prove it at his “trial tomorrow,” he said.

At the same time, the lawyer of the victim of 911 Hotman Paris, Zahra Amalia, appreciated the requests of the prosecutor. According to him, the prosecutor’s request for the defendant ABH was appropriate, which is one third of the adult sentence.

“It is according to the demands that were given to the three accused. And he hopes that the judge can give a sense of justice to the victim’s family,” he said.
