2022 Amendment to Act on Fuel Quality Monitoring: Suspension of Coal Quality Standards Amid Energy Security Threats

The 2022 amendment to the Act on the fuel quality monitoring and control system allows for the possibility of abandoning the application of quality standards for coal if there are extraordinary circumstances that threaten energy security. This applies to solid fuels sold to households and for use in installations with a nominal thermal power of less than 1 MW.

Suspension of quality standards for coal. The Ministry of Culture and National Heritage has decided on the extension

The requirements for coal are defined, among others, by admissible content of ash, sulfur, grain size or calorific value. The standards did not apply until July 31, when the previous regulation abolishing them expired.

Meanwhile, it is already known that the Ministry of Climate and Environment extended the suspension of quality standards for coal until the end of the year, justifying the decision with the ongoing war in Ukraine.

Russia’s invasion of Ukraine continues, causing an energy crisis. This has a negative impact on the change in the conditions of supply of solid fuels, which pose a threat to energy security. The changes introduced temporarily take into account the interests of consumers and ensuring energy security and thermal comfort.

As indicated in the justification for the draft ordinance, in the government’s opinion, failure to comply with the quality requirements for solid fuels may lead to deepening of social stratification and will contribute to increasing the scale of energy poverty.
