20 years in prison for ‘Inha University sexual assault’ perpetrator… Murder is ‘unrecognized'[플랫]

A court sentenced a student to 20 years in prison for raping a classmate at Inha University and pushing her to death by pushing her out of a window.

The Incheon District Court’s 12th Criminal Division (Presiding Judge Lim Eun-ha) said at a sentencing hearing held on the 19th that it had sentenced 20 years in prison to Mr. A (21), who was indicted for quasi-rape and murder. The court also ordered Mr. A to complete an 80-hour sexual violence treatment program, and restricted him from getting a job at an institution related to children, youth or the disabled for 10 years.

In a decision trial held earlier last month, the prosecution asked for life imprisonment for Mr. A.

Mr. A was indicted on charges of sexually assaulting a drunken unconscious classmate on the 2nd and 3rd floors of a building at Inha University in Michuhol-gu, Incheon around 1 am on July 15 last year, and dropping him out of a window, causing him to fall to his death.

The judge said, “Mr. A used a classmate at the same school as a tool to relieve his sexual desire and tried to rape him while drunk.” This is extremely bad,” he said. The judge continued, “The classmate who died was a freshman in college and ended a noble life without any wrongdoing without ever realizing his dreams.” It is difficult to dare to guess the shock,” he revealed the reason for the sentencing.

The judge, however, did not recognize the charge of intentional murder applied to Mr. A by the prosecution. Previously, the police applied the crime of quasi-rape and manslaughter, which is applied when the murder was not intentional, and sent it to the prosecution.

Mr. A also admitted to the fact that he fell to his death while trying to rape a classmate who was drunk and unable to resist, but denied the murder charge, claiming that he had no intention to kill.

However, the prosecution applied the charge of intentional murder, saying that Mr. A could have predicted the death of a classmate who fell from a height of 8m. Intentional murder is recognized when the possibility of death was anticipated and there was a perception that death could not be helped.

The judge explained, “It doesn’t appear that Mr. A, who was drunk, was aware of the danger and acted.” The judge added, “It is difficult to admit that he tried to kill his classmate because he had a casual conversation with the classmate who died while drinking before the crime, and there was no reason to quarrel or have bad feelings afterwards.”

Accordingly, the court applied the charge of quasi-rape and manslaughter to Mr. A.

At the request of the victim, Mr. A’s trial was held privately, and only the sentencing hearing was made public that day. Previously, Inha University held a student punishment committee and expelled A.

Meanwhile, it is known that the prosecution will decide whether to appeal after receiving the ruling.
