The suspect in the murder of a member of the Laskar Defenders of Islam (Front Defenders of Islam)REITs), Ipda M Yusmin Ohorella and First Brigadier Fikri Ramadhan were acquitted. Brigadier Fikri was found guilty of murder and mistreatment that led to death but was in defense.
“Declaring that the actions of the defendants Fikri Ramadhan and M. Yusmin as the primary indictment in the context of the defense were forced to exceed the limit, stating that they cannot be sentenced for reasons of justification and forgiveness,” said Chief Justice M Arif Nuryanta when reading the verdict at the South Jakarta District Court, Friday. (18/3).
The judge ordered the public prosecutor to release the defendant and restore the defendant’s rights.
“Releasing the defendant from all lawsuits. Restoring the rights of the accused,” he said.
This verdict is lighter than the demands of the public prosecutor who wants both of them to be sentenced to six years in prison.
Previously, the public prosecutor (JPU) assessed that Yusmin and Fikri were legally and convincingly proven to have committed the crime of murder together. Prosecutors then demanded that both of them be sentenced to 6 years in prison.
The demand is in accordance with the primary indictment, namely Article 338 of the Criminal Code on intentional murder in conjunction with Article 55 paragraph (1) of the Criminal Code.
In this case, members of the Laskar FPI were involved in a chase and shootout with members of the police from Polda Metro Jaya. The incident occurred in front of the Novotel Hotel, Jalan Interchange, Karawang, West Java to the KM 50 area of the Jakarta-Cikampek Toll Road on December 7, 2020.
The prosecutor said that Laskar FPI members were shot at close range by three members of the Polda Metro Jaya, namely Ipda Elwira Priadi Z (deceased), First Brigadier Fikri Ramadhan, and Ipda Mohammad Yusmin Ohorella.
A total of two FPI members were killed in the shootout. Meanwhile, four other people died when they were about to be taken to the Polda Metro Jaya alive.
The National Human Rights Commission (Komnas HAM) declared the killing of the four FPI Laskars as unlawful killings. Meanwhile, two other victims died in law enforcement actions.
