A truck driver old 42 years old appeared Thursday, December 17, 2020 at Lisieux court (Calvados) for endangering others. On September 9, 2020, he had not respected the rest and driving times – of only a few minutes – but, above all, he had been checked with an alcohol level of 2.68 g per liter of blood.
Dangerous behavior
It was a Romanian driver who had informed the gendarmerie of his dangerous driving. He had explained that the driver had passed him on the A13 at the level of the municipality of Cricqueville-en-Auge (Calvados) in the direction of Paris had suddenly fallen back after having passed it. He had been forced to brake sharply and enter the emergency stop lane. He honked the driver’s horn and then caught him to see if he had dozed off.
Arrived at his cabin, the man had given him a middle finger then had tightened to the left before zigzagging to prevent it from passing.
He got lost
Alerted by the foreign driver, the soldiers of the motorized platoon of Pont-l’Évêque checked the forties at 5:05 p.m. at the toll station of Dozulé (Calvados). The man who was parked, engine running, was sleeping soundly at his wheel.
While he had to join his depot in Morbihan after leaving Amiens at the start of the day, he retraced his steps by driving towards Paris. The reconstruction of his route will show that he got lost in the exits of the Caen ring road. The forty-something, father of two children who was the subject of an administrative suspension of his driving license was dismissed following the facts.
“A malaise”
At the bar of the court, the father admits having bought a few beers on a motorway rest area and drank them while driving. In a weary voice, he speaks of fatigue and anguish: “A malaise”.
If he admits that he was not in his normal state, he claims to have no recollection of the facts with which he is accused. This gray area will be taken advantage of by his lawyer. Pointing to the fact that the Romanian driver was absent at the hearing, and that his statements were made by telephone, Me Leandri questions the notion of “endangering others” which, according to him, is not characterized .
The truck driver was sentenced to 5 months suspended sentence. His license is suspended for 6 months. They are required to complete a road safety awareness course within 6 months.
