19 states sue the Trump administration for diverting funds to the border wall | Univision Immigration News

In their argument they affirm that the measure is unconstitutional and that it also ignores the possibility of causing damage to the environment.

California, Colorado, Connecticut, Hawaii, Illinois, Maine, Maryland, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, Wisconsin, Massachusttes, Virginia and Michigan indicate in their lawsuit that President Donald Trump he disrespected the separation of powers by acting contrary to congressional legislation by redirecting billions of dollars that that public power had approved for the Department of defense, not for the border wall.

The lawsuit also indicates that the government did not sufficiently assess the impact on nature, which violates the National Environmental Policy Act (NEPA).

“President Trump is risking the safety of all Americans by diverting dollars contributed by taxpayers to our armed forces to finance the same promises of the xenophobic campaign for the past four years,” said New York attorney general Letitia James, one of the 19 attorney generals who are suing the White House.

In the lawsuit, the New Jersey attorney general states that the state may be affected “by the possible loss of equipment for its National Guard” which has more than 8,000 soldiers and employs 1,500 people full-time and operates 365 facilities in the state . “The New Jersey National Guard receives almost 85% of its funding from the federal government. The New Jersey National Guard provides emergency public security to civil authorities,” says the legal document that establishes similar arguments to the extent that each State raises its own complaint.

In mid-February, the American Civil Liberties Union (ACLU) announced a similar legal initiative by announcing that it will block in court the new request for funds for the wall made by President Trump.

The lawsuit of the 19 states states that the Trump administration violates the doctrine of separation of powers; violates the submission clause; violates the appropriations clause and exceeds the authority of Congress, “among others.
