2. Membership/Participation Participation in the competition takes place by actively participating in the competition on Instagram or in the newsletter according to the methods provided. Participation is not conditional on the purchase of goods or the use of a service of Reisetopia GmbH. Purchasing a product or using a service does not increase your chances of winning. Participation in the contest includes your consent to mention your name or Instagram name on the Reisetopia Instagram page and on the Reisetopia website if you win. Entries to enter the Sweepstakes must not contain insults, false facts, competition, trademark or copyright infringement.
3. Eligible Participants All natural persons living in Germany or Austria can participate. Excluded from this are employees and authorized representatives of Reisetopia GmbH.
4. Other conditions of participation Participation is only possible via the Internet. By entering the contest, the participant agrees to the contest rules. Participation is only possible within the period specified in the competition.
5. Winner determination and entry deadline The competition takes place from 17/12/2022 at 10:00 to 18/12/2022 at 9:59. The winner will be determined by drawing lots unless otherwise specified.

Travel is not included in the prize, the prize applies to hotel accommodation only. Also not included are all other costs that arise during the trip. All costs for further meals, extra services such as additional massages, travel or similar costs are to be paid by the winner himself. Redemption is subject to hotel availability only, blackout dates are possible. The prize cannot be paid in cash or transferred to third parties. The winner will be notified within one week of the draw at the latest.
7. Announcement of winners and deadline for acceptance Winners will be notified by direct message via Instagram or by email. If the winner does not respond within 7 calendar days of notification, the prize will be forfeited and an alternate winner will be drawn.
8. Governing Law The competition is subject exclusively to German law.
9. Delivery of the Prize The winner will receive a voucher once contact with Reisetopia has been established.
10. Opportunity for Termination Reisetopia GmbH reserves the right to cancel or terminate the contest at any time without notice. This applies in particular if the competition cannot run as planned for any reason, such as software and/or hardware errors and/or other technical and/or legal reasons affecting administration, security, integrity and/or affecting the regular and fair conduct of competition. In such cases, reisetopia GmbH also has the right to change the contest at its own discretion.
11. Confidentiality To participate in the competition it is necessary to provide personal data. The participant expressly agrees that the data transmitted by him for the implementation and processing of the competition will be collected, processed and passed on to the partners for the purpose of conducting the competition. The participant also agrees to be able to receive messages relating to the company Reisetopia GmbH at the e-mail address provided by him. No further processing of the personal data collected exclusively within the framework of the competition takes place. In case of revocation, the participant will be excluded from the competition.
12. Legal Recourse and Liability The legal process is excluded. There is no enforceable right to payment of winnings. Reisetopia GmbH is not liable for loss, delay, modification, manipulation and/or misdirection of emails and/or data during data entry, collection, transmission and/or storage , that their cause in external data networks, in particular the Internet, in external telephone lines and/or other hardware and/or software of the participants and/or third parties; this applies in particular to incorrect, missing, interrupted, deleted or defective data. Reisetopia GmbH is also not liable for incorrect information caused by the participants and/or third parties, their hardware and/or software and which are used for or in connection with the competition. In particular, we decline all responsibility in the event that the e-mails or data entered do not meet the requirements set forth therein and consequently are not accepted and/or accepted by the system. Furthermore, Reisetopia GmbH is not liable in the event of theft or destruction of the systems and/or storage media storing data or in the event of unauthorized modification and/or manipulation of data in the systems and/or storage media by of the participants or third parties. Otherwise, Reisetopia GmbH is only liable for gross negligence or willful actions on the part of its legal representatives, employees or vicarious agents. Furthermore, Reisetopia GmbH is not liable for damages suffered by the winner or relatives of the winner in connection with the prize. The aforementioned exclusion of liability does not apply if liability is mandatory, for example in the event of intent, gross negligence, injury to life, limb or health or breach of essential contractual obligations. However, the damages claim for breach of essential contractual obligations is limited to the contractually typical and foreseeable damage, unless liability is assumed for intent or gross negligence or for injury to life, limb or health. A change in the burden of proof to the detriment of the participant is not related to the above regulations.
13. Severability clause If a provision of the conditions of participation is or becomes invalid, the validity of the remaining provisions remains unaffected. In this case, organizers and participants are required to collaborate in the creation of provisions that pursue a result that comes as close as possible to the economic result of the ineffective provision.
