The ITC of the US International Trade Commission raised LG’s hand in a dispute between LG Energy Solutions and SK Innovation in infringing battery trade secrets.
In the case of infringement of trade secrets that LG filed against SK, ITC made a final decision to admit some of the claims from LG.
Accordingly, the supply and production of SK’s lithium-ion batteries in the U.S. is prohibited for 10 years, but due to the needs of the U.S. automaker, Ford is temporarily allowed to supply for 4 years and Volkswagen for 2 years.
Prior to this, LG applied for an investigation to ITC in April 2019, claiming that SK has removed its manpower and infringed trade secrets regarding rechargeable battery technology.
SK stressed that it was not an obvious decision to infringe trade secrets after being defeated by shock.
LG urged SK to enter into negotiations with reasonable security.
Although President Biden may veto the ITC decision within 60 days or SK may appeal to the federal court, it is unlikely that the two sides are expected to engage in a dialogue for an agreement sooner or later.
