It is known that the prosecution, who is investigating the allegations of the assault of a taxi driver by Vice Minister of Justice Lee Yong-gu, recently obtained a video of the assault scene of Lee.

Seoul Central District Prosecutor’s Office 5th Criminal Division (Director Prosecutor Dong-Eon Lee) reported on the 20th that a 30-second image of the scene where Lee grabbed Mr. A’s neck from a taxi driver’s cell phone was restored. The prosecution also secured a digital driving record of Mr. A’s taxi on November 6, last year, when the incident took place, and is checking whether the vehicle was in operation at the time of the assault.

The police who previously investigated the case of the Vice Minister said that there was no video of the taxi black box to prove the assault while driving, and it was concluded that the assault occurred after stopping at the destination.

In December of last year, the prosecution received a mobile phone and an SD card in the taxi black box from Mr. A and performed digital forensic work. The SD card was recorded for only 2 or 3 hours, and the video was not left over because it was continuously overwritten. The video was on Mr. A’s cell phone. On the day of the incident, Mr. A, who reported the Vice Minister Lee to the police, found that the black box video was erased, and the next day, he restored the video containing the assault situation through a private black box company. To secure evidence, Mr. A played this video and filmed it with his mobile phone. A agreed with Vice Minister Lee and deleted the video from the mobile phone, but the prosecution is said to have recovered the video through digital forensic work. The prosecution is also checking whether there is any clue to the specific location of the incident and that the vehicle was in operation by receiving a digital operation record of Mr. A’s taxi on the day of the incident. All taxis registered in Seoul transmit location and speed information on the GPS and information about passengers’ boarding and disembarkation points linked to the meter every 10 seconds to the computer server. If it is determined that Mr. A was in operation at the time of the incident, the Specific Crime Weighted Penalty Act is applied, and the victim may be subject to punishment regardless of his intention to punish. On the 19th, the prosecution was reported to have reconstructed the situation by examining the road around the apartment complex in Seocho-gu, Seoul, where the incident occurred while investigating Mr. A.

However, it is unclear whether the charges against the driver assault will be applied under the Special Act only by the fact that Vice Minister Lee took the head of Mr. A. A deputy judge of the Seoul District Court said, “If you exercised the tangible power to be seen as assault while driving, you can apply the charge of assaulting the driver, but if it was stopped like this, it’s a matter to judge after seeing the details in the video.”
