With the verdict of the Darmstadt Regional Court, two investigations by the financial control of illegal employment at the main customs office in Frankfurt am Main were recently concluded. The investigations were directed against two suspects who, together with their companies, performed construction work in the Rhine-Main area and employed workers for several years who were not or not correctly registered for social security. The accused disguised this undeclared work by using so-called cover bills, with which they generated the black money they needed. In total, cover bills from service companies to the amount of approx. 3.82 million EUR were used, resulting in total damage to the Deutsche Rentenversicherung, the tax office, the SOKA-Bau and the BK-Bau in the amount of 630,000 EUR. In the spring of this year, one of the defendants was sentenced by the Darmstadt Regional Court to a prison term of 2 years and 3 months, of which he had already spent about 1 year in custody. With the current verdict, the second defendant has been given a suspended sentence of 11 months. In addition, the regional court ordered the confiscation of the proceeds of several hundred thousand euros.

The amount of damage in the course of the criminal and administrative fine investigation amounts to around 13.3 million euros. 2,023 individual criminal offenses were concluded, as well as 1,372 administrative fines. 1,493 criminal proceedings were initiated, as well as 572 individual proceedings for administrative offenses. The sum of the fixed warning fines, fines and confiscation amounts amounts to 523,650 euros. The financial control of illegal employment secured, among other things, account amounts, cash and luxury goods in the amount of around 4.2 million euros to secure the claims of the state. One focus of the investigation was directed against employers in several industries who tried to disguise their black wages by means of chain fraud.
