CLAUSE FOR PROCESSING PERSONAL DATA FOR ADDITIONAL PURPOSES
In accordance with the provisions of the Personal Data Protection Law – Law 29733 (hereinafter, the “Ley”) and in Supreme Decree 003-2013/JUS – Regulation of the Law (hereinafter, the “Regulation”), being that legally in the digital environment, the statement consisting of “click”, “click”, “puncture”, “Give a touch”, “touch”, “pad” or other similar ones, you grant your total and absolute consent to IMPORTACIONES HIRAOKA SAC (hereinafter, “HIRE”), with RUC No. 20100016681, domiciled at Avenida Abancay No. 594, Cercado de Lima district, province and department of Lima, Peru; so that, in his capacity as owner of the personal data bank of private administration called “Customers” with Registration Code No. 03616 in the “National Registry of Personal Data Protection”, approved by Resolution No. 1155-2015-JUS/DGPDP/DRN, carry out the processing of personal data, especially their full names and surnames, type and number of identity document, emails, contact telephone numbers and addresses (hereinafter and jointly as the “Personal information”), which are granted by you and/or to which you allow access by: (i) filling out the registration form; (ii) use of the website https://www.hiraoka.com.pe (hereinafter, the “Website”); and/or (iii) telephone calls.
Therefore, this Clause for the Treatment of Personal Data (hereinafter, the “Clause”) regulates the way in which HIRAOKA will treat the personal information that you provide to HIRAOKA or that is obtained with your consent through the Website, for the following purposes:
(i) Statistical and historical, such as segmenting and/or creating profiles with the same promotional or advertising purpose, adapted to your profile as a user of HIRAOKA services;
(ii) Use and analyze the information collected to administer, support, improve and develop the services of HIRAOKA and/or the Website https://www.hiraoka.com.pe.
(iii) Know if you are interested in acquiring any of the products and/or services offered by HIRAOKA;
(iv) Suitably respond to requests for information that you may make to HIRAOKA;
(v) Send you the proformas, budgets and characteristics of the products and/or services offered by HIRAOKA;
(vi) Periodically send you information regarding promoted products and/or services, catalogues, newsletters, news, offers, raffles and/or commercial campaigns regarding the products and/or services offered by HIRAOKA (including the Shopping Guide, the same as has a monthly periodicity) on the products marketed by HIRAOKA, and on the activities and services developed by HIRAOKA, as well as third-party companies with which HIRAOKA maintains commercial agreements and that offer their products and services through the Website, and/or people who market or offer products and/or services that improve the value offer for HIRAOKA customers; either through telephone call systems, sending text messages to cell phones, mass electronic messages, physical catalogs through courier, or similar.
Personal Data will be processed in accordance with the Peruvian regulations on the protection of personal data and electronic commerce applicable at all times. Likewise, HIRAOKA may use and analyze the information collected to administer, support, improve and develop its services and/or the Website.
With this acceptance, you express your total agreement and consent for HIRAOKA to treat the Personal Data provided in accordance with the Law, the Regulations, the “Privacy Policy, treatment of Personal Data and use of cookies” and Clause.
You agree to receive all commercial information by post, physical catalogs through courier, telephone call systems, email, SMS, or any other equivalent electronic means of communication.
HIRAOKA will treat the Personal Data at all times in an absolutely confidential manner and keeping the mandatory duty of secrecy with respect to them, in accordance with the provisions, adopting the necessary technical and organizational measures to guarantee the security of said data and avoid its alteration, loss, treatment or unauthorized access.
Finally, you declare to have full knowledge of:
(i) The existence of the personal data bank owned by HIRAOKA in which the Personal Data will be stored, whose office is located at Avenida Abancay No. 594, district of Cercado de Lima, province and department of Lima, Peru;
(ii) The legal consequences of granting your consent for the processing of Personal Data in accordance with the Clause and the possibility of revoking it, for which you can send an email with your request to the following email address: [email protected] and/or go to the following physical address: Avenida Abancay No. 594, district of Cercado de Lima, province and department of Lima, Peru;
(iii) The terms and conditions of the “Privacy Policy, treatment of Personal Data and use of Cookies”, which you have read and understood in its entirety.
(iv) The time during which the Personal Data will be kept, which will not exceed two (2) years from the last time you entered the HIRAOKA platform through your username and password; and,
(v) The possibility of exercising the rights granted by the Law and the Regulations, which are listed below: (a) right to information; (b) right of access; (c) right to update, include, rectify and delete; (d) right to prevent supply; (e) right of opposition; (f) right to objective treatment; (g) right to guardianship; and, (h) right to be indemnified.
