The lawyer, Me Boucounta Diallo denounces irregularities in the procedure for allocating 225 ha to the Sedima Group. He maintains that this deliberation is illegal and can be challenged before the Supreme Court. The former president of the ONDH (National Organization of Human Rights of Senegal) also accuses the boss of the Sedima of attempting unjust enrichment in this case.
“The rural council of Sindia, at the time, deliberated on a non-existent object. This is called in administrative law, the act of exceeding one’s powers. And when an administrative authority exceeds its powers, we speak of the illegality of the measure that has been taken. Even if the Sedima benefited from this deliberation, it is struck by illegalities and that can be the subject of an appeal to the Supreme Court for excess of power, “declared the lawyer, also a native of Djilah.
Me Diallo also deplores the transformation of the lease which is a customary title into land title which is a property right. According to him, the boss of Sédima clearly sought to enrich himself through this transaction.
“Djilah can be sold at 10,000 F per square meter. With 225 ha, you have 22 billion 250 million. So whoever tells us that he has invested 2 billion for this land title in this village ends up with 22 billion because of 10,000 F per square meter. ”
He invites the authorities to take the necessary steps to recover this land title, if they wish the return of peace to this locality.
