Mediaset trial, Silvio Berlusconi and judge Amedeo Franco: «Your sentence? A rubbish »

“Berlusconi must be condemned a priori because he is a rascal”, “has suffered a serious injustice”. An environmental interception – anticipated by Reformist and broadcast on TV Fourth Republic – rekindled the controversy over the intricate story of the Mediaset TV rights. A trial concluded in 2013 in Cassation with the conviction of the Knight for tax fraud. But just one of the judges called to decide, Amedeo Franco, would have defined that sentence «a mess». The audio file (here the complete text) was sent by Berlusconi’s lawyers to the European Court of Strasbourg together with one recent ruling by the Milan court which would offer an opposite reconstruction of the case.

The judge’s words

Franco’s words would have been recorded in 2013, after the August ruling, in a private interview with Silvio Berlusconi and other witnesses who recorded everything. On that occasion the judge, now deceased, claimed that at the beginning he had not wanted to sign the reasons for the sentence (here the full text). And that that was not even the right section for the trial (“what’s the point of sending it to the working section? Such a delicate matter …”). The existence of the interception had been made known by Berlusconi himself last year a Door Door. Now, reveal The newspaper, that audio file was sent by the Knight’s lawyers to the European Court of Strasbourg where Berlusconi had appealed against its irrevocability (in 2018, however, the judges had closed the case without sentence).

The new sentence

The sentence of 2013, claim the Knight’s lawyers, would have been questioned by one recent judgment of the Court of Milan. Judge Damiano Spera – rejecting the request for damages from Reti Televisivee Italiana (Berlusconi’s TV center) – writes that Agrama’s mediation was not fictitious and the contracts were effective. According to Berlusconi’s lawyers, this ruling would offer a very different reconstruction from the 2013 sentence. Not surprisingly, he reveals The newspaperwould have been sent to Strasburgor together with Franco’s audio.

«Judicial coup»

The vice president of Forza Italia, Antonio Tajani, he starts the attack: «Who is it that from above decided that the Cassation should condemn Berlusconi? Who was the director of the conspiracy that changed the history of Italian politics in recent years? A real judicial coup” “A judicial coup not only against Berlusconi but against democracy of our country »adds Tajani in a press conference at Palazzo Madama in which the request for one was anticipated parliamentary commission of inquiry . Of “rigged sentence, altered to the point of changing the course of Italian political historyinstead, the vice-president of the Forza Italia group speaks to the Senate, Licia Ronzulli. “Today we can state even more clearly that it was not a sentence but a political execution by judicial means” added the group leader to the Chamber Mariastella Gelmini.

Salvini: now justice reform

“Disgust, compared also to respectable magistrates,” comments the leader of the League Matteo Salvini, during the transmission Quarta Repubblica by Nicola Porro. «We will try to make one justice reform – adds Salvini – a reform not against but with the magistrates ». «It is yet another proof that in Italy there is a piece of judiciary that does politics and attacks political opponentsinstead of seeking justice and giving answers to citizens “he attacks Giorgia Meloni, president of Fratelli d’Italia. Request for “clarity” also comes from the leader of Italia Viva, Matteo Renzi: «I don’t know where the truth is but I know that a serious country on a story like this – linked to a former Prime Minister – can not pretend anything. For me Berlusconi is a political opponent. But, precisely for this reason, it is necessary to clarify what comes out of the audio».

Esposito: «Never under pressure»

Judge Antonio Esposito, president of the section of the Supreme Court that condemned the Knight, has never “in any way, undergone pressure either from above or from any other direction”. This is what the magistrate himself says in a note, in reference to the audio story of Judge Amedeo Franco. In particular, the note underlines how Esposito “never came under pressure from the Public Prosecutor’s Office of Milan with which he never had any contact”.
