“Berlusconi must be condemned a priori because he is a rascal”, “has suffered a serious injustice”. An environmental interception – anticipated by Reformist and broadcast on TV Fourth Republic – rekindled the controversy over the intricate story of the Mediaset TV rights. A trial concluded in 2013 in Cassation with the conviction of the Knight for tax fraud. But just one of the judges called to decide, Amedeo Franco, would have defined that sentence «a mess». The audio file (here the complete text) was sent by Berlusconi’s lawyers to the European Court of Strasbourg together with one recent ruling by the Milan court which would offer an opposite reconstruction of the case.

The judge’s words
Franco’s words would have been recorded in 2013, after the August ruling, in a private interview with Silvio Berlusconi and other witnesses who recorded everything. On that occasion the judge, now deceased, claimed that at the beginning he had not wanted to sign the reasons for the sentence (here the full text). And that that was not even the right section for the trial (“what’s the point of sending it to the working section? Such a delicate matter …”). The existence of the interception had been made known by Berlusconi himself last year a Door Door. The new sentence
The sentence of 2013, claim the Knight’s lawyers, would have been questioned by one recent judgment of the Court of Milan. Judge Damiano Spera – rejecting the request for damages from Reti Televisivee Italiana (Berlusconi’s TV center) – writes that Agrama’s mediation was not fictitious and the contracts were effective. According to Berlusconi’s lawyers, this ruling would offer a very different reconstruction from the 2013 sentence. Esposito: «Never under pressure»
Judge Antonio Esposito, president of the section of the Supreme Court that condemned the Knight, has never “in any way, undergone pressure either from above or from any other direction”. This is what the magistrate himself says in a note, in reference to the audio story of Judge Amedeo Franco. In particular, the note underlines how Esposito “never came under pressure from the Public Prosecutor’s Office of Milan with which he never had any contact”.
