Alleged Defamation Case Reported by the Founder of Kaskus, Police Determine 2 Suspects Page all


JAKARTA, – The National Police named Titi Sumawijaya Empel and Jack Boyd Lapian as suspects in the alleged defamation case reported by Kaskus founder Andrew Darwis.

This was conveyed by the Head of the Public Information Bureau of the Police Public Relations Division Brigadier General (Pol) Awi Setiyono via teleconference video, Tuesday (6/30/2020).

“From the results of the case title it was decided that the JBL brothers and sisters of TSE were upgraded from witnesses to suspects,” said Awi.

Previously, Andrew reported both of them on the report registered with the number LP / B / 097 / XI / 2019 / Bareskrim on November 13, 2019.

After the Criminal Investigation Directorate General of the Criminal Investigation Police carried out the title of the case on June 16, 2020, both were named suspects.

As police say, police have also examined a number of witnesses in this matter.

“Investigators have examined as many as 14 witnesses, 1 expert linguist witness and 1 criminal witness expert,” he said.

Titi was charged with Article 310 of the Criminal Code and Article 311 of the Criminal Code. The threat of punishment in Article 310 is a maximum of nine months imprisonment or a maximum fine of Rp 4,500. Meanwhile, the criminal threat in Article 311 of the Criminal Code is a maximum prison of four years.

Meanwhile, Jack is subject to Article 45 paragraph 3 jo Article 27 paragraph 3 of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning ITE.

The maximum threat of punishment is four years in prison and / or a maximum fine of Rp. 750 million.

The police have also sent summonses to the suspects on Monday (6/29/2020) yesterday.

Both suspects are planned to be examined on Thursday (2/7/2020).

Reportedly, the report posted by Darwis began with Titi who reported Andrew on a case of alleged forgery.

In addition to reporting Titi, Darwin also reported Jack Boyd Lapian who was Titi’s lawyer at the time. Both were reported on charges of defamation.

“As citizens who are protected by their right to dignity and dignity, our clients have reported the police and applied for legal protection to the authorities,” said Abraham Sridjaja, one of Andrew Darwis’s attorneys in Cikini, Central Jakarta, Friday (15) / 11/2019).

According to Abraham, his client did not know or even communicated with Titi who was then reporting Darwin. Thus, it is unlikely that Darwin later deceived Titi.

“So our client, Mr. Andrew Darwis, does not know and has never even met, let alone borrowed and lent. So we think these are things that cannot be proven,” he said.

Abraham also explained the reporting of Jack Boyd Lapian who at that time was Titi’s attorney who said that the basis of reporting to Andrew was due to fraud.

In fact, according to him, the attorney should not have given that statement.

“So Jack Boyd Lapian said the words ‘we suspect Andrew Darwis is falsifying as well as money laundering.’ As law enforcers, you shouldn’t suspect someone committing a crime, “Abraham said.

Contacted separately, Titi’s lawyer, Jack Lapian said the report began when Titi borrowed Rp 15 billion from David Wira with collateral for a building on Jalan Panglima Polim, South Jakarta.

The loan process was carried out in November 2018.

“David Wira is believed to be Andrew Darwis’ right hand man. The reporter (Titi) wants to borrow Rp. 15 billion, but only Rp. 5 billion has been realized,” Jack said in his written statement.
